Student Pulse Survey - Contest Rules

CONTEST IS GOVERNED EXCLUSIVELY BY THE LAWS OF ONTARIO.

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

ApplyBoard Inc. (“ApplyBoard”) is excited to announce the launch of the Student Pulse Survey (the “Contest”). Take a few minutes to share your perspective on the international student experience. Where are you interested in studying? What are you looking for in an institution? Every student who completes the survey via the link provided by ApplyBoard (the “Survey”) can enter a draw to win a gift card or prepaid credit card worth the equivalent of CAD $250!

The following terms and conditions (“Rules”) apply to the Contest:

1. Contest Period. The Contest is open only for a limited time; it begins on February 25, 2025 at 8:00 AM, Eastern Time (“ET”) and ends on March 11, 2025 at 11:59 PM ET (the “Contest Period”).

2. Eligibility The Contest is open to Eligible Students, who (i) have reached the age of majority in their province/territory/state of residence at the time of entry, or (ii) who are between the ages of 16 and the age of majority in their province/territory/state and whose parents or legal guardians have consented to these Rules and their child’s entry into the Contest.  “Eligible Student” means a prospective international university/college student who has been contacted by ApplyBoard to complete the Survey.

3. How to Participate. NO PURCHASE NECESSARY. Eligible Students participate in the Contest by submitting one Student Pulse Survey Form through the relevant survey link (the “Submission”) during the Contest Period. By entering your Submission, you warrant and represent that (i) you, or your parent(s) or legal guardians(s) as applicable, have read and agree to be legally bound to the Rules; (ii) the Entry is your original work, created solely by you, and over which you have all necessary rights, title, and interest, including copyright; (iii) the Entry does not infringe upon the intellectual property rights, or defame or invade the publicity or privacy rights, of any third party, living or deceased; (iv) you, or your parent(s) or legal guardian(s) as applicable, consent to the use of your names, voices, pictures, and likenesses and the content of your submission for advertising and promotional purposes in any medium throughout the world in perpetuity without additional compensation unless prohibited by law by ApplyBoard or its subsidiaries; and (v) you agree to release and hold harmless ApplyBoard and its affiliates from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement, or any other intellectual property related cause of action that relates in any way to ApplyBoard’s use of the Entry. An eligible Submission will automatically result in one (1) entry (the “Entry”) into the random prize draw (see section 5).

There is a limit of one (1) Submission per person permitted during the Contest Period. If it is discovered that any person has attempted to: (i) obtain more than one (1) Submission per person during the Contest Period; and/or (ii) use (or attempt to use) multiple names or identities to make more than one (1) Submission; then (in the sole and absolute discretion of ApplyBoard) they may be disqualified from the Contest and each Entry voided. Your Submission will be rejected if (in the sole and absolute discretion of ApplyBoard) the instructions and Rules are not followed and are not submitted and received during the Contest Period. Use (or attempted use) of multiple names, identities, and/or any automated,  lost, misdirected, delayed, incomplete, or incompatible Submissions and Entries (all of which are void).

Submission and Entry are subject to verification at any time. ApplyBoard reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to ApplyBoard—including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of ApplyBoard in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid Submission in this Contest will be the Contest server machine(s).

In these Rules, for an application to constitute a qualifying Submission, it must satisfy the following conditions:

a. Unique. The Submission must be unique and has never previously been submitted through the Student Pulse Survey Form (whether by the submitting Eligible Student or otherwise). 


b. Complete, accurate, and truthful. The Submission must be complete and include only accurate and truthful information. Failure to provide such information to the satisfaction of ApplyBoard may result in disqualification.

4. The Prize and Approximate Retail Value. There will be ten (10) prizes available to be won, each consisting of one (1) CAD $250 gift card or a CAD $250 digital prepaid credit card (or an approximately equivalent prepaid credit card or gift card in a different currency) as determined by ApplyBoard in its sole and absolute discretion (the “Prize”). The Prize must be accepted as awarded and is not transferable, assignable, or convertible to cash (except as may be specifically permitted by ApplyBoard in its sole and absolute discretion). No substitutions except at ApplyBoard’s option. ApplyBoard reserves the right, in its sole and absolute discretion, to substitute the Prize or any component thereof with a prize of equal or greater value, including, without limitation, a cash award. The Prize will only be awarded to the person whose verifiable full name and valid email address appears on the Submission. The value of the Prize will be taxable to the winner as income. All federal, provincial, state, municipal, and local taxes and any other costs and expenses associated with the acceptance and/or use of the Prize not specifically provided for in these Rules are solely the winner’s responsibility. Winner is solely responsible for reporting and paying any and all applicable taxes.

5. Random Prize Draw and Winner Selection. There will be one (1) random prize draw on or about March 20th, 2025 (the “Draw Date”) in Kitchener, Canada. Ten (10) eligible Submissions will be selected by random draw from among all eligible Entries received during the Contest Period on the Draw Date (each a “Selected Entrant”). The odds of winning depend on the number of eligible Entries received during the Contest Period.

ApplyBoard, or its designated representative, will make a minimum of one attempt to contact the Selected Entrant(s) via email on the Draw Date. If a Selected Entrant cannot be contacted, or if there is a return of any notification as undeliverable, or if a Selected Entrant does not claim the prize within five (5) business days of being announced as a winner; then they will be disqualified from the Contest (and will forfeit all rights to the Prize) and ApplyBoard reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible Submission from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new Selected Entrant). 

BEFORE BEING DECLARED A CONFIRMED PRIZE WINNER, the Selected Entrant may also be required, at ApplyBoard’s discretion, to: (a) (Only required for Canadian residents) correctly answer a mathematical skill testing question without mechanical or other aid; and, (b) sign ApplyBoard’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases ApplyBoard and each of their respective officers, directors, agents, representatives, successors, and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, their participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and, (iv) agrees to the publication, reproduction, and/or other use of their name, address, voice, statements about the Contest, and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of ApplyBoard in any manner whatsoever, including print, broadcast, or the internet.

If a Selected Entrant: (a) fails to correctly answer the skill testing question (only for Canadian residents); (b) fails to return the properly executed Contest documents within the specified time; and/or (c) cannot accept the Prize as awarded for any reason; then they will be disqualified (and will forfeit all rights to the Prize) and ApplyBoard reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible Entry from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new Selected Entrant).

6. General Conditions. All Entries become the property of ApplyBoard. This Contest is subject to all applicable federal, provincial, state, and municipal laws. The decisions of ApplyBoard with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. By participating in this Contest, you are agreeing to be legally bound by the terms and conditions of these Rules.

The Releasees will not be liable for: (i) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (ii) the failure of any Entry to be received for any reason, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (iii) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; (iv) the failure of any Eligible Recruitment Partner or Selected Entrant to receive any email or correspondence from ApplyBoard regarding the Contest; and/or (v) any combination of the above. 

In the event of a dispute regarding who submitted an Entry, Entries will be deemed to have been submitted by the Eligible Student at the time of entry. ApplyBoard reserves the right, in its sole and absolute discretion, to withdraw, amend, or suspend this Contest or to amend these Rules in any way, without prior notice or obligation. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by ApplyBoard in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, ApplyBoard reserves the right to seek remedies and damages to the fullest extent permitted by law. 

By entering this Contest, each entrant, or their parent(s) or legal guardian(s) as applicable, expressly consents to ApplyBoard, its agents and/or representatives, storing, sharing, and using the personal information submitted with his/her Entry only for the purpose of administering the Contest, or as otherwise agreed to in the Rules, and in accordance with ApplyBoard’s privacy policy (available at: https://www.applyboard.com/privacy-policy). Any material submitted and/or entered into the Contest is the sole property of ApplyBoard and may be used by ApplyBoard for any purpose. The entrant represents that they independently created the material submitted to ApplyBoard. The entrant assigns and conveys to ApplyBoard all right, title, and interest in and to the submitted material(s) and all copyright, trademark, and other intellectual property rights in the submitted material(s), and agrees to take any actions (including execution of documents) reasonably requested by ApplyBoard to effect, perfect, or evidence the foregoing assignment.

ApplyBoard reserves the right, in its sole and absolute discretion, and without prior notice, to adjust the Rules, including but not limited to, any of the dates and/or time frames stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of ApplyBoard, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

The use of the Prize is governed by the respective prepaid credit card or gift card vendor’s terms and conditions. To the extent the Prize is lost or stolen, ApplyBoard is not responsible for lost or stolen Prizes. ApplyBoard is not responsible for any failure of a Eligible Student to receive an email or electronic message sent by ApplyBoard or for ApplyBoard’s failure to receive an email or electronic message sent by an Eligible Student for whatever reason, including, without limitation, due to any automatic spam-filtering that may be applied by an email provider, internet service, or network provider.

In the event of any discrepancy or inconsistency between the Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the website and/or point of sale, television, print, or online advertising; the terms and conditions of these Rules shall prevail, govern, and control.

The Contest is governed exclusively by the laws of the Province of Ontario without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts in Toronto, Ontario.
